It qualifies a good-faith representation of quantity. By using the phrase, the parties mutually acknowledge that the true circumstances may differ from what the parties believe they are when the contract is made, and accept a risk that the true quantity will be slightly different. When the qualifying phrase is present, neither party can recover for a surplus or deficiency.
