Under the National Labor Relations Act, a genuine opening in an employer’s workforce, resulting from the employer’s expanding its workforce or discharging a particular employee, or from an employee’s resigning or otherwise leaving the employment. • The opening must be offered to striking workers, in order of seniority, after a strike has been resolved. Laidlaw Corp. v. NLRB, 414 F.2d 99 (7th Cir. 1969).
